1. Agreement to Terms

Welcome to RestOrTrain! These Terms of Service ("Terms") govern your access to and use of the RestOrTrain website, applications, and services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

RestOrTrain is the ultimate cycling AI - an AI chat that knows everything about your cycling, from individual rides to your entire fitness history. The Service uses data from your activity files (such as .fit files) to generate insights, track progress, and provide personalized feedback through conversational AI powered by third-party artificial intelligence technologies.

The RestOrTrain App and the insights provided by its AI are for informational and educational purposes only. They are not intended to replace professional medical advice, diagnosis, or treatment. You should always consult with a physician before starting any fitness program or changing your diet.

ASSUMPTION OF RISK

By using RestOrTrain, you acknowledge that exercise involves inherent risks, including physical injury, heart attack, or death. You agree that you are using this App at your own risk. If you experience faintness, dizziness, pain, or shortness of breath at any time while exercising, you should stop immediately and seek medical attention.

AI LIMITATIONS

This App utilizes Artificial Intelligence (AI) to analyze data and generate chat responses. You acknowledge that AI is probabilistic and may generate incorrect, unsafe, or inappropriate advice ("hallucinations"). The AI does not know your specific physical limitations, medical history, or real-time condition.

NO RELIANCE

You must not rely on the App's AI Chat for decisions related to health, safety, or medical conditions. Always use your own judgment and common sense when interpreting the AI's training suggestions or performance feedback. RestOrTrain is not responsible for any actions you take based on AI-generated content.

NOT A CRISIS SERVICE

RestOrTrain is a fitness tool, not a mental health service or suicide prevention tool. AI-generated feedback regarding your performance is automated data analysis and should not be taken as a personal judgment of your worth. If you or someone you know is experiencing a mental health crisis, emotional distress, or thoughts of self-harm, please stop using the App immediately and contact emergency services or a suicide prevention hotline.

3. User Accounts & Age Requirement

To use the Service, you must register for an account and provide accurate information. You agree to the following:

  • You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are 18 years or older.
  • You are responsible for safeguarding your account password and for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Your Content and Data

You Own Your Content. You retain full ownership of all the data, files, and information you upload or create on the Service, including your activity files and performance metrics ("User Content").

License Grant to Us. To allow us to operate and provide the Service, you grant RestOrTrain a worldwide, non-exclusive, royalty-free, and transferable license to use, host, store, reproduce, modify, and create derivative works from your User Content. This license is for the sole purpose of operating, developing, and improving the Service, and it ends when you delete your User Content or your account.

5. Acceptable Use

You agree not to misuse the Service. For example, you must not:

  • Upload or share any content that is unlawful or infringes on the rights of others.
  • Attempt to reverse engineer, decompile, or discover the source code of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service to build a competitive product.

6. Third-Party Services

To enhance our analysis, the Service may utilize third-party services, including AI platforms like OpenAI. As detailed in our Privacy Policy, we may send your cycling activity data (which does not include personally identifiable information like your name or email) to these services via secure enterprise APIs that contractually forbid them from using your data for their own model training.

7. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of RestOrTrain. This includes our branding, code, and visual design. You may not use our name or trademarks without our prior written permission.

8. Termination

By You. You are free to stop using our Service at any time and can terminate your account from your account settings page.

By Us. We reserve the right to suspend or terminate your account at our discretion if you breach these Terms or use the Service in a way that causes legal liability or disrupts others' use of the Service. Upon termination, your license to use the Service will cease, and we will delete your User Content in accordance with our Privacy Policy.

9. Disclaimers and Limitation of Liability

9.1 Service Disclaimers

Health Disclaimer. The Service provides performance analysis for informational purposes only. It is not intended as medical advice. You should consult with a qualified medical professional before beginning any new fitness program. You assume full responsibility for your own health and safety.

"AS IS" Service. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

No Professional Relationship. Your use of the Service does not create a doctor-patient, coach-athlete, or any other professional relationship between you and RestOrTrain.

9.2 LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • IN NO EVENT SHALL RESTORTRAIN, ITS FOUNDER, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
    • PERSONAL INJURY OR DEATH
    • PROPERTY DAMAGE
    • LOST PROFITS OR REVENUES
    • LOSS OF DATA OR USE
    • EMOTIONAL DISTRESS OR MENTAL ANGUISH
  • THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS, OR €100, WHICHEVER IS GREATER.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless RestOrTrain and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kraków, Poland. For users within the European Union, you may also access the EU's Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr.

11. Changes to Terms

We may revise these Terms from time to time. We will notify you of any material changes by posting a notice on our website or sending an email to the address associated with your account. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Terms.
